How this is calculated

Most ET claims are subject to a "3 months less 1 day" limitation period from the act complained of (Employment Rights Act 1996 s.111). Time pauses while ACAS Early Conciliation runs:

  • The clock stops on Day A (when you notify ACAS).
  • The clock resumes on Day B (when the EC certificate is issued).
  • Time between A and B is added back to the original deadline.
  • Plus, the deadline cannot be earlier than one month after Day B.
