I Want My Rental Deposit Back

Your landlord must return your deposit promptly after you move out. If they are delaying or proposing unfair deductions, here is how to challenge them and recover what you are owed.

Take a full set of dated photographs and video of every room before you hand back the keys. Attend the check-out inspection if one is offered. Ask for a copy of the check-out report. Take final meter readings. Return all keys and document that you have done so.

Chase the deposit return

Allow 10 days from move-out

Your landlord must return the deposit (or propose deductions) within 10 days of you both agreeing the final amount. Send a written request (email is fine) if you have not heard from them. Keep a record of all communication.

If your landlord proposes deductions, request a written itemised breakdown. You are not liable for fair wear and tear — this is normal deterioration from everyday use. Check each deduction against your inventory and photos. Respond in writing disagreeing with any you believe are unreasonable, and explain why.

Consider court action if the deposit was not protected

If your landlord never protected your deposit at all, this is a serious breach. You can apply to a county court for between 1 and 3 times the deposit amount as a penalty, plus the return of the deposit itself. You can use the small claims track for amounts up to £10,000.
